If a wrecker is about to tow you out of this lot and the towing company is coercing you to pay $750 (or more than $100) in order to release the vehicle, call the police and cite the laws listed below. TENNESSEE LAW — MOTION ACT OF 2025 If a wrecker has begun towing your vehicle but the vehicle has not left its original parking location, Tennessee law requires the towing company to immediately release it upon payment of the lawful release fee. T.C.A. §55-31-204(c): “A person attempting to tow a motor vehicle shall immediately release the vehicle that the person has begun to tow if: (1) The motor vehicle has not left the original parking location; and (2) The owner or operator of the motor vehicle pays a release fee.” T.C.A. §55-31-207(e)(3): The release fee cannot exceed $100 when the vehicle is being towed without the owner's express written authorization. T.C.A. §55-31-103(c): A violation of §55-31-204 is a Class B misdemeanor. A second or subsequent offense is a Class A misdemeanor. Therefore, if your vehicle has not left the original parking location, offer to pay the lawful release fee. If the towing company refuses to release the vehicle in violation of §55-31-204, call law enforcement and cite T.C.A. §§55-31-204(c) and 55-31-103(c). If they demand more than $100 for the release fee in a tow covered by §55-31-207(e)(3), cite that section as well.
